Introduction
Welcome to Dwyer Baseball Edge (“we,” “our,” or “us”).
These Terms & Conditions (“Terms”) govern your use of our website, programs, services, content, emails, forms, digital products, training resources, virtual services, lessons, camps, clinics, and related materials.
By accessing or using our website, submitting information through our forms, purchasing a product, registering for a program, submitting video, or participating in any Dwyer Baseball Edge service, you agree to these Terms. If you do not agree, please do not use our website, content, products, programs, or services.
Purpose of Our Website & Services
Dwyer Baseball Edge provides baseball-related educational content, pitching instruction, training resources, coaching information, lessons, programs, camps, clinics, digital products, virtual development options, video review, and communication related to player development and athletic performance.
Our content and services are intended to help athletes, parents, and families make more informed training decisions. Accessing our website, joining our email list, purchasing a product, submitting video, registering for a program, or participating in a lesson or service does not guarantee specific results, increased velocity, improved performance, roster placement, recruiting opportunities, scholarships, college offers, injury prevention, or future access to products or services.
Eligibility, Minors & Parent/Guardian Consent
Dwyer Baseball Edge serves youth athletes, parents, and families. If a participant is under the age of 18, a parent or legal guardian is responsible for reviewing these Terms, approving participation, completing any required forms, submitting any video or materials, and making any purchases or registrations on behalf of the minor athlete.
By submitting information, registering an athlete, purchasing a product, submitting video, or allowing a minor to participate in any Dwyer Baseball Edge program or service, the parent or legal guardian confirms that they have authority to do so and accepts responsibility for the minor athlete’s participation.
We do not knowingly seek to collect personal information directly from children under 13 without appropriate parent or guardian involvement. Parents or guardians should complete forms, purchases, registrations, and virtual assessment submissions for minor athletes.
Use of Our Content
All content provided through Dwyer Baseball Edge, including but not limited to videos, graphics, training materials, PDFs, programs, emails, website copy, logos, branding, images, templates, digital downloads, course materials, and social media content, is the property of Dwyer Baseball Edge or used with permission and is protected by copyright, trademark, and intellectual property laws.
You may not copy, reproduce, distribute, resell, publish, modify, upload, share, or use our materials for commercial purposes without written permission from Dwyer Baseball Edge.
Digital products, downloads, training materials, and program resources are provided for personal use only by the purchaser, athlete, or family. They may not be shared with teams, organizations, coaches, players, groups, or third parties without written permission.
Media, Photos, Videos & Athlete Footage
Dwyer Baseball Edge may capture, record, create, or obtain photos, videos, audio, screenshots, written feedback, testimonials, training clips, lesson clips, performance clips, throwing clips, pitching clips, drill footage, or other media during in-person lessons, training sessions, camps, clinics, programs, events, and other Dwyer Baseball Edge activities.
By registering for, participating in, or allowing a minor athlete to participate in Dwyer Baseball Edge lessons, training sessions, camps, clinics, programs, events, or related activities, you acknowledge and agree that Dwyer Baseball Edge may capture, obtain, edit, use, reproduce, publish, display, and share photos, videos, audio, training footage, performance footage, and other media obtained during those activities for coaching, educational, training, website, email, social media, advertising, marketing, and promotional purposes.
This may include use on the Dwyer Baseball Edge website, landing pages, email communications, social media accounts, digital products, educational materials, promotional materials, advertisements, and other brand-related platforms or materials.
For athletes under the age of 18, a parent or legal guardian is responsible for deciding whether the athlete may participate in activities where photos, videos, or training footage may be captured or used. By registering a minor athlete for Dwyer Baseball Edge lessons, programs, training sessions, camps, clinics, or events, the parent or guardian grants Dwyer Baseball Edge permission to capture and use footage obtained during those activities unless the parent or guardian provides a written request otherwise.
Parents or guardians who do not want their minor athlete’s image, likeness, name, voice, photo, video, or training footage used for public-facing promotional purposes must notify Dwyer Baseball Edge in writing before the athlete participates, or as soon as possible after registration.
Dwyer Baseball Edge will make reasonable efforts to honor written requests not to use future public-facing promotional images or videos of a minor athlete. However, removal may not apply to materials already printed, published, posted, shared, distributed, used in advertisements, or captured by third-party platforms before the request is received and processed.
Virtual Pitching Assessment Video Submissions
Dwyer Baseball Edge may offer virtual pitching assessments, video review, online coaching, or other remote services that require athletes or parents to submit videos, photos, forms, written answers, measurements, performance information, or other materials.
Videos, photos, and information submitted for virtual pitching assessments or online review may be used internally by Dwyer Baseball Edge for coaching, review, evaluation, communication, recordkeeping, and service delivery.
Dwyer Baseball Edge will not use publicly, publish, post, advertise, or share public-facing footage, photos, videos, names, likenesses, voices, testimonials, or other identifying media of a minor athlete submitted specifically for a virtual pitching assessment or online review without separate parent or guardian consent.
Submission of virtual assessment footage does not automatically grant Dwyer Baseball Edge permission to use that footage publicly for marketing or promotional purposes if the athlete is a minor. Public-facing use of a minor athlete’s virtual assessment submission requires separate parent or guardian permission.
Virtual assessment submissions from adult athletes, or from parents/guardians on behalf of minor athletes, may still be reviewed internally by Dwyer Baseball Edge for the purpose of providing the purchased or requested service.
Testimonials, Feedback & Results
If you submit written feedback, testimonials, messages, reviews, results, before-and-after information, performance updates, or other comments to Dwyer Baseball Edge, you grant Dwyer Baseball Edge permission to use, edit, publish, and share that feedback for educational, marketing, website, email, social media, and promotional purposes.
For testimonials, photos, videos, or identifying information involving athletes under the age of 18, parent or guardian permission is required before public-facing use.
Dwyer Baseball Edge may edit testimonials or feedback for length, clarity, grammar, or formatting, but will not intentionally change the meaning of the statement.
Acceptable Use
You agree not to misuse our website, content, products, programs, or services. This includes, but is not limited to:
Sharing paid materials with others who have not purchased access
Copying or republishing our content as your own
Attempting to interfere with the function or security of our website or platforms
Submitting false, misleading, or inaccurate information
Using our content or services for unlawful, harmful, or unauthorized purposes
Harassing, threatening, or abusing Dwyer Baseball Edge, its representatives, coaches, athletes, families, or other participants
We reserve the right to restrict, suspend, or terminate access to our content, programs, or services if these Terms are violated.
Email Communication
By submitting your information through our website, forms, landing pages, checkout pages, or registration pages, you consent to receive emails from Dwyer Baseball Edge. These emails may include program updates, educational content, announcements, marketing messages, promotional offers, reminders, and other communication related to Dwyer Baseball Edge.
You may unsubscribe from marketing emails at any time using the unsubscribe link included in our emails. Please note that we may still send necessary transactional or program-related emails related to purchases, registrations, scheduling, safety, payment, account access, or active participation in a program or service.
Payments, Purchases & Registration
Certain Dwyer Baseball Edge products, programs, lessons, camps, clinics, virtual services, or resources may require payment. By making a purchase or registering for a paid service, you agree to provide accurate payment and registration information.
Payment may be processed through third-party platforms, payment processors, scheduling tools, or other service providers. We do not control the policies, security practices, fees, or processing timelines of third-party services.
A spot in a program, camp, clinic, lesson, training group, or service is not guaranteed unless registration requirements are completed and payment has been received, unless otherwise stated in writing.
Refunds, Cancellations & Access
All sales of digital products, downloads, online courses, training resources, video-based materials, templates, PDFs, virtual assessments, video reviews, and other digital resources are final and non-refundable once purchased, unless otherwise stated in writing.
Because digital products and resources may be accessed, downloaded, viewed, or used immediately after purchase, Dwyer Baseball Edge does not offer refunds, returns, cancellations, or exchanges for digital purchases.
For virtual assessments, video reviews, or online coaching services, purchases are non-refundable once payment has been submitted, work has begun, videos or materials have been reviewed, or the assessment has been delivered, unless otherwise stated in writing.
For in-person programs, camps, clinics, lessons, or training groups, refund, credit, makeup, and cancellation policies may vary by program and may be communicated on the applicable registration page, checkout page, email, or written program materials.
Refunds, credits, makeups, or cancellations for in-person services may be limited due to scheduling, facility costs, staffing, roster limits, and program planning.
Dwyer Baseball Edge reserves the right to modify, reschedule, postpone, or cancel a program, lesson, camp, clinic, training session, or service when necessary due to weather, facility issues, coach availability, safety concerns, low enrollment, emergency circumstances, illness, injury, or other factors outside our control.
Educational, Training & Medical Disclaimer
All information provided by Dwyer Baseball Edge is intended for educational, instructional, and informational purposes only.
Dylan Dwyer and Dwyer Baseball Edge are not providing medical advice, physical therapy, rehabilitation, diagnosis, treatment, athletic training services, or individualized healthcare guidance. Dylan Dwyer is not acting as a doctor, physician, physical therapist, athletic trainer, certified strength and conditioning coach, medical provider, or licensed healthcare professional.
Unless specifically stated otherwise in writing, Dwyer Baseball Edge is also not providing certified strength and conditioning services, physical therapy services, injury rehabilitation, medical screening, return-to-play clearance, or individualized medical programming.
Participation in baseball training, pitching instruction, throwing programs, strength work, mobility work, drills, exercises, conditioning, lessons, camps, clinics, digital programs, virtual services, or athletic activity involves inherent physical risk. These risks may include soreness, fatigue, discomfort, overuse, pain, strain, injury, or other physical issues.
Athletes should stop any activity that causes pain, unusual discomfort, dizziness, numbness, weakness, shortness of breath, or concerning symptoms and should consult a qualified medical professional when appropriate.
Parents and guardians are responsible for determining whether an athlete is healthy enough to participate in any Dwyer Baseball Edge content, program, lesson, drill, exercise, virtual service, or training activity.
Dwyer Baseball Edge does not diagnose injuries, treat injuries, provide rehabilitation plans, clear athletes to return to play, or replace the advice of a qualified medical professional.
Dwyer Baseball Edge does not guarantee injury prevention, increased velocity, improved mechanics, improved command, recruiting outcomes, scholarships, roster placement, or any specific athletic, health, or performance result.
Assumption of Risk
By participating in any Dwyer Baseball Edge training, lesson, program, camp, clinic, virtual service, digital program, drill, exercise, throwing activity, or athletic recommendation, you acknowledge that baseball and athletic training involve risks.
Participants and their parents or guardians voluntarily assume all risks associated with participation, including risks related to throwing, pitching, strength training, conditioning, facility use, equipment use, and following educational or instructional materials.
Parents and guardians are responsible for supervising minor athletes when using digital content, online training resources, virtual feedback, or at-home drills.
In-Person Programs, Facilities & Waivers
Some Dwyer Baseball Edge programs, lessons, camps, clinics, or services may take place at third-party facilities. Participants may be required to complete additional waivers, releases, safety forms, or facility agreements before participating.
Failure to complete required forms may result in delayed or denied participation.
Dwyer Baseball Edge is not responsible for the policies, conditions, equipment, staffing, rules, or safety procedures of third-party facilities.
Virtual Services & Video Review
Dwyer Baseball Edge may offer virtual assessments, online coaching, video review, digital programs, or remote training resources.
Virtual services are limited by the quality, angle, completeness, and accuracy of the videos and information submitted. Recommendations are based only on the materials provided and should not be considered a medical evaluation, physical evaluation, diagnosis, treatment plan, rehabilitation plan, or guarantee of results.
Dwyer Baseball Edge reserves the right to decline, limit, or modify virtual services when a player’s needs appear to require in-person instruction, medical evaluation, physical therapy, athletic training, injury rehabilitation, return-to-play clearance, or another form of support outside the scope of our services.
Results Disclaimer
Athletic development depends on many factors, including consistency, effort, health, age, maturity, strength, mobility, mechanics, recovery, coaching environment, training history, and competition level.
Testimonials, examples, case studies, videos, player stories, or past results are not guarantees that another athlete will experience the same or similar outcome.
Third-Party Services & Links
Our website, emails, content, and services may include links to or integrations with third-party platforms, including but not limited to website providers, email marketing platforms, payment processors, scheduling tools, form providers, video platforms, analytics tools, social media platforms, facility websites, and communication tools.
We are not responsible for the content, policies, security, availability, accuracy, or practices of any third-party service. Use of third-party platforms is subject to their own terms, privacy policies, and practices.

Indemnification

Dwyer Baseball Edge may update, modify, remove, replace, or discontinue website content, emails, programs, services, offers, products, pricing, availability, schedules, or materials at any time.
We do not guarantee that any specific product, program, lesson, service, or resource will remain available in the future.
